Brand New Car stolen and recovered minimal damages can we ask for a new one?... Out car was stolen /car jacked less than 24 hours after we got it , the kid was most likely a local bum drove from LA to vegas... ,my other half says she doesn't want it. Can we ask the insurance to make apayment to cover the value and take any losses taxes etc.. and just go and buy another one....
what rights do we have... any tips in getting a better case...?ie possible engine damage from miss use and abuse on brand new engine etc....

3) You'll have to talk with your insurance company, but I doubt they will cover your loss beyond making whatever repairs are necessary to put the car back to the condition it was before it was stolen. (less your deductable)
I can't blame your spouse for wanting to get rid of the car, but you'll have to deal with the difference in cost between your trade-in and a new car.

Look up your car value on line at kelly blue book and type in how many miles you had on it before it was stolen. the miles he drove it should be added into your insurance check! - rhonda
5) Oh, you can ask, but I doubt if your insurance company will honor your request. Your car was worth several thousand dollars less than what you paid for it the minute you drove it off the lot. The car wasn't totaled, only damaged - the insurance company is only going to pay for the damages. And, if the engine was damaged, the insurance company should pay for that.

You have the option of 'cashing out' if you like and not repairing the car at all. You can sell it as is and go buy another one.

You may want to call your finance company and let them know what happened. When your policy canceled, the finance company may have put "forced coverage" in place. This is insurance they put on the note to cover their interest. It would not pay for any equity you have in the car...but would pay for the balance of the note.
If the finance company did not put forced coverage into place, you will need to work something out with them.
If you stop paying for the car - they will do a "paper repo" which is the same as a regular repo only they are not picking up the car b/c it's stolen. - MSAD

got into an accident insurance expired other drver no license cops say both our fault HELP!?... i got into an accident and my insurance expired two days prior to the accident. the other driver did not have a license. the police report claims they are unable to determine who is at fault. what are my options?

5) It might help to call a lawyer to see what your options are. I'd take this into consideration. The other driver shouldn't have been on the rode in the first place without a license. A good traffic lawyer might be able to argue that for you in court.
You could post an ad in your local newspaper asking witnesses to respond and testify for you. It seems strange that the police weren't able to determine who was at fault. That's part of their job. Who's car was damaged the most, from what angle, were there traffic lights in the area???
At least call a lawyer. There are some that don't charge a fee for the initial consultation.

If you go to a comparison website you can punch in all your details and get quotes for different types of vehicles, even if you don't presently have a vehicle. It's not possible for us to know how much it would cost for you as we all have different circumstances.
