Is it legal to sign a release form without seeing the car first?

Question 1
Is it legal to sign a release form without seeing the car first?... A couple of days ago my niece's car was towed for non-payment.Unfortunately the car is on my name because I bought the car at the beginning but she wanted it so she took over the payments.Or so I though. I went to pick up the car at the repossession place and when I got there I was told to sign some release papers, stating that I would not find them reliable to anything that could have happened to the car. When I refused to sign such papers until I see my car they told me that if I don't sign them I wouldn't be able to have my car back.So I signed the papers and when I finally saw the car it had the muffler torn apart and the front bumper was hanging loose. Now my question is : Can they just get away with this?

Answers
1) It is legal but NOT wise - Tim L

2) Of course they can.

Keep something in mind, it's not her car. It belongs to the financing company.

And unless the financing company has a problem with the car getting damaged....it doesn't matter what shape it gets returned to your niece in. It's not her property getting damaged.

If anything, you can report it to the financing company. And they will likely say something similar. They just wanted the car back, and didn't care how. The fact that she doesn't like the damage....not their problem.

But give it a try anyway, if you want. - Vipassana

3) Sure it's legal, but it's not a very good idea... - Bandit-05

4) Time to look at the cost...

Lawyer or repair cost.. bottom line cost and go with the cheaper one.

And you can and should post a small claims court filling for the cost of repairs you may get that.

Next time you call the bank and demand that they send a rep to view the car with you before you sign.. just the call will most likely fix the problem. - Bruce M

Question 2
I signed my car title to my mom 4 yrs ago. She never changed it to her name and got into an accident today.?... So, my question is, am I at fault in anyway for her accident today?

Answers
1) Were you the car/pole/tree/bush/insert object here, that she came into collision with? If no, that you're not at fault. - ℓ.σ.ν.є'ѕ נυѕт αησтнєя ωσя∂

2) As long as the insurance is in her name, then you should probably be ok. I've been in a wreck when the car was in my dad's name and he didn't get in any trouble for it. - Nicole B

3) There are three items that will determine the $$ outcome of the accident. The title was signed over to your mom. Does the bank, finance company, State, know this? And is it registered in her name? Title and registration are two separate items. And most important, Does the insurance company know that you signed the title to her? does the insurance police name her as the registrant and main driver of the vehicle. - Joseph

4) You should ask a lawyer. I did the same thing with this lady that I know and it was still in on my insurance policy. She was letting her boyfriend drive it and I was afraid that he would crack it up. She finally put it in her name after 3.5 years. - Reverend White Al Sharpton

Question 4
Is there any NC License Loopholes?... Hi, I'm 16 years old and have had my permit since January 27, 2009. In my state (North Carolina) you need to have your permit for a year before you can get your license. Are there any loopholes to this rule? I would be willing to go to another state nearby to get my license, if that would work. I really need to get my license because of my part-time job, so any input would be fantastic. Thanks!

Answers
1) Well, your little scheme wouldn't work, because you have to be a resident of a state before you can get a license there. - Scott H

2) No, there aren't any loopholes. You can only get a license from your state of residence. If there were any loopholes, they would have found out about them and closed them by now. Wait your turn. - gomanyes
