Question 5
My friend totalled my car and my car was uninsured. What will happen?... I let my best friend borrow my car in early September because she was carless. She went to get the car inspected in mid September but since the rear tire rods were worn down, the inspection failed. She took my car to her step dads garage where he agreed to do the work for for much cheaper. I was under the impression that the car was sitting at the garage waiting to be fixed, She told me two weeks ago thst she still had to give her step dad money for the part so he could fix it. She also had said that she wouldn't be needing the car since she was getting her car together. I didn't pay the insurance at the end of September because I thought it was sitting in a garage and since I am unemployed and do not need the car it was an unnecessary expense. My friend never told me if the car had been fixed and if she was driving it. She got into a car accident last night. She hydroplaned due to the rainy weather and lost control of the vehicle. She collided head on with another vehicle. She received a concussion, stitches, and bruises on her leg. The other driver was uninjured but damage was done to the car. Upon exiting the car to talk to the other driver, another car rear ended the vehicle she had just left. I found out that she was driving my car and the car is now totalled.

I had no idea she was driving my car since I was under the impression that it was still at the garage. My car was uninsured. Am I going to get into trouble for her accident? The accident was deemed to be no ones fault and no citations were issued. There is a police report and accident report. Her boyfriend is telling me this situation is my fault because of the lapse in insurance coverage. However, she lead me to believe the car was waiting to be repaired, that she was getting her car in order, and she never mentioned that she had been driving it or for how long. I had no idea she was driving the car or I would have told her it wasn't insured anymore. What is going to happen to me? Am I responsible for the other cars damages even though I had no idea it was being driven? or is my friend responsible? She is unisured as well.

Answers
1) You need to talk to a lawyer ASAP! - chit for brains

2) My best guess is that this will wind up in a court case; gather all info you have including the police report and the termination of insurance paperwork with the date of termination on it. You and your friend will have to go to court and tell the Judge exactly what happened - that you were unaware the vehicle was being used by your friend, you canceled the insurance due to the vehicle being in the shop, etc, etc. No one can tell you what the outcome will be and other people may advise you to get a lawyer, but a lawyer probably will not take on a case that he/she cannot get any $$ from

PS your friend was driving recklessly - the car hydroplaned due to the rain, yes, but because your friend was driving too fast for the conditions..........always slow WAY down when driving in any inclement weather - this may even be brought up in the court - not 2 B fooled

3) you are in/you let insurance lapse/she is also in but you are the owner and thats where they will go/after her and you/ - ken k

4) When you have loaned out your car, you have also loaned out your insurance. If you allowed your insurance to lapse, it wasn't covered. Yes, it was your uninsured car that caused the damage, and your responsibility to pay for it. All the rest of it is window dressing and doesn't matter. Your car, not insured, being driven by someone you gave permission to drive it, your fault. Pay for the damage. - oklatom
