Question 3
In a car accident and insurance refuses to cover the damages.?... I have had full coverage on my vehicle since last january, paying $300 dollars a month because I hadn't had insurance or a car in a few years. last week I was in a car accident. The woman in front of me slammed on her breaks, and hit the woman in front of her, I was following a full car lengths distance behind her, at 45mph....the speed limit there, and breaked as quickly as humanly possible....but hit the back of her vehicle. Her Chevy Blazer took no damage really, a few scuffs on her bumper, the woman in front of her, same thing....a few scuffs, my kia was crunched in the accident. The officer that came to the accident, took all of our insurance info, registration info, and drivers licence's and sat in his car, filled out the report without talking to all of us, handed us our info, handed me a ticket and left. My car was towed, I filed the claim with my insurance.
The next morning I get a call from the claims department at my insurance, she informs me that the specific full coverage policy I have (at $300 dollars a month) only works if I'm less then 50% at fault for the accident. The police report lists me as 100% responsible for the accident. The policy writer that signed me up for this policy never informed me of that specific rule, he also doesn't work for that company, he just writes for them on occasion. I need to get copy's of my original documents signed when I purchased the policy, I also know I need to see the original police report.
... now I have a 12,000 dollar debt for a car that isn't looking repairable, and even if it was it would cost me a very pretty penny.
So....what do I do?
Answers
1) When it comes time for renewal automobile insurance is a no brainer way to save a lot of money. You can get a easy quote online they often give you multiple quotes.
I tell my friends about http://www.InsureAutoNow.info - Charles R
2) You may have to go to court. It maybe worthwhile to talk with a lawyer. Another possibility is to talk to your state Insurance Commissioner.
I once had a very expensive stereo stolen from my car. My insurance company wouldn't cover me for the stereo because they said "it wasn't pemenantly mounted" it was a pull out deck. I called the Insurance Commissioner and within a couple of weeks my company gave me a voucher to have the deck replaced. - thefox
3) As far as being at fault, you hit them from behind, almost always 100% of the time it's your fault. As far as that policy, you need to read the fine print. They might be correct, they might be bluffing. If you blew the airbags, look to get the car totaled out, it's too much $$$ to repair. - dragginman_73
4) It is up to the insurance adjuster to determine liability. The police report is merely a tool used to conclude liability. If the car in front of you rearended the car first and then you rearended them, you would only be responsible for the rear damages of the car in front of you. Your insurance adjuster would need to get a statement from all parties. If the front driver indicates that they felt two impacts and the first one was the hardest, that would indicate that the middle car rear-ended them first. Definitely contact your insurance adjuster and see if they have talked to the other drivers. Hope this helps!! - brittni0877
5) I hate to break it to you, but you are 100% responsible for hitting the car in front of you. Even though you "braked as quick as humanly possible", you didn't have enough room to keep from rear ending the car in front of you.
I've never heard of insurance coverage that only pays if you are less than 50% at fault. What good is it, then? Maybe you should have read your policy when you signed up for this coverage?
Your insurance company isn't "refusing" to cover your damage. They will only cover you as stated in the policy. There's a difference between refusing and honoring their contractual obligation. - Scott H

Question 4
Can I pay out of pocket instead of file an insurance claim?... I was at fault in an accident involving two other vehicles while driving my friend's parent's car. I do not wish to tarnish the vehicle's registered owner's squeaky clean insurance rate, so I am considering paying out of pocket for all of the damages, even though the insurance would cover me. I am not from the United States and am not sure how it works here, but would I be able to pay out of pocket for the damages (under $5000) instead of file a claim? How would I go about doing this in a legal, spotless fashion?
Answers
1) YES, you can.
Does that mean you'll be paying for damages to 'BOTH' cars?
Just be SURE Neither owner files a Claim.
Get Estimates on both Cars,
Have a "CASHIERS" Check made out to EACH parties for the Estimated amount.
On the 'left' bottom corner of the check, where it says "For", put in 'Accidental Damages to Car and that Car's License plate Number' and make the check out to the OWNERS. Then keep the 'Carbon' copy and give the check to them.
Once the check is Accepted and cashed for Accidental Damages and the license-plate number is on the check, it is their Admission/Acceptance you have 'paid-off' your responsibility and you will be in the clear.
"IF" the damages aren't that bad and either decide to 'keep' the money and NOT repair their car, your Carbon copy is PROOF you ,made ammends/did you part, the rest is up to them. - Trouble
2) you can do that, i did that for 3000.00 worth of damage while i was at fault, you probably need tp file a police report quickly just so they know, and thats as far as it goes then you pay the othre person out and thats about it. - Snoman
3) Getting new car insurance is one of the simplest ways to save a ton of money. You can get a quick estimate at websites they often give you lots of prices.
I have used http://www.InsureAutoNow.info - Keri H
4) All parties would have to agree for you to pay out of pocket. More than likely, someone has already filed a claim. I would check on that first before paying out anything. Honestly, it is better just to let the insurance carrier take care of it. - brittni0877
